How Capital Gains Tax Works in India

Capital gain generally arises when you transfer a capital asset for more than its tax cost. The taxable amount may differ from the simple difference between sale value and purchase cost because eligible expenses, exemptions and special asset rules can affect the calculation.

From 23 July 2024, the Finance (No. 2) Act, 2024 changed the holding periods and tax rates for many assets. Many long term gains are generally taxed at 12.5% without indexation, but listed equity has separate rules and some assets remain subject to slab rates or special provisions. Read the Income Tax Department’s guidance on capital gains.

Listed bonds and debenturesGenerally more than 12 monthsSpecial rules can apply to the particular instrument.
Unlisted sharesGenerally more than 24 monthsLong term gains are generally taxed at 12.5%, subject to applicable rules.

This table is a simplified overview. Specified mutual funds, market linked debentures, unlisted bonds and other special instruments can have rules that override ordinary holding period treatment.

Why the Equity Exemption Is Different

The ₹1.25 lakh annual threshold applies to qualifying long term gains covered by Section 112A. It is an aggregate threshold for eligible gains in the financial year, not a separate exemption for every sale. This calculator applies it only to the transaction entered, so it cannot calculate your complete annual tax position.

Property Indexation and the Transitional Rule

For eligible property acquired before 23 July 2024 and transferred on or after that date, a resident individual or HUF may qualify for a transitional comparison that limits tax under the amended method to the tax under the earlier method. Conditions apply, and a simple comparison of 12.5% without indexation with 20% using indexation is only an estimate.

Cost Inflation Index

The notified Cost Inflation Index is used for eligible indexed cost calculations. The current table includes 376 for FY 2025 to 2026 and 384 for FY 2026 to 2027. Check the official Cost Inflation Index table and verify that indexation applies to your transaction.

How to Use the Calculator

Select your asset, enter the purchase cost, sale value and eligible transfer expenses, then provide the holding period. For equity, confirm the applicable STT conditions. For property, review the acquisition date and financial years. Select a slab rate when required by the selected category.

Important: This tool provides an indicative estimate for general information. It does not calculate cess, surcharge, Sections 54, 54F or 54EC exemptions, brought forward losses, annual aggregation of gains, the grandfathering adjustment for eligible equity investments, non resident rules or every special asset provision. Verify the applicable law or consult a qualified tax professional before filing a return.

Frequently Asked Questions

Q. What changed in capital gains tax from 23 July 2024?

Ans. The Finance (No. 2) Act, 2024 changed holding periods and tax rates for many assets. Many long term gains are now taxed at 12.5% without indexation, while qualifying equity gains and some special asset categories follow separate rules.

Q. Is the ₹1.25 lakh exemption available on every long term capital gain?

Ans. No. The annual threshold applies to eligible long term gains covered by Section 112A. It does not apply to every asset category, and your other eligible gains during the same financial year must also be considered.

Q. How are physical gold and gold ETFs classified?

Ans. Physical gold and listed gold ETFs can have different holding period treatment. Physical gold generally uses a 24 month threshold under current rules, while listed securities generally use a 12 month threshold. Confirm the classification of your particular investment.

Q. How are specified debt mutual funds taxed?

Ans. Units covered by Section 50AA are treated as short term capital assets for tax purposes, regardless of holding period, and the gain is generally taxed at the applicable slab rate. Check the acquisition date and fund classification.

Q. Can I use indexation when selling property?

Ans. Indexation is not generally available under the new 12.5% method. An eligible resident individual or HUF selling qualifying property acquired before 23 July 2024 may be covered by a transitional comparison. Conditions apply.

Q. Does this calculator include cess and surcharge?

Ans. No. The displayed tax is an indicative estimate before cess and surcharge. Your final tax can depend on total income, tax regime, other gains, exemptions and carried forward losses.

Q. Does this calculator include exemptions under Sections 54 and 54EC?

Ans. No. The calculator does not estimate reinvestment exemptions. These provisions have eligibility requirements, investment limits and deadlines that must be checked separately.

Q. Can I use this result to file my income tax return?

Ans. Use it as an initial estimate only. Verify the applicable provisions and your full annual tax details, or consult a tax professional before filing.
